Notifications Regarding Family Registers (戸籍届出(出生・死亡・婚姻・離婚))

In Japan, there is a system of family registers. Under this system, individual births and deaths, and changes to personal status (marriage, etc.), are recorded and documented officially.
Foreigners living in Japan must also notify the City Office in the case of a birth or death. It is also necessary to notify the City Office when a foreigner and a Japanese citizen marry or divorce. You should also notify the government of your own country.

Notifications of Birth(出生届)

When a child is born in Japan, you must submit a Notification of Birth to the Citizens’ Affairs Division in the City Office, or to a branch office or sub-branch office of the City Office. If both the mother and the father are foreigners, then even if the child is born in Japan, he/she cannot obtain Japanese nationality. You should obtain the child’s nationality in accordance with the laws of the parents’ countries.

Formalities

1. Submit a Notification of Birth to the Citizens’ Affairs Division of the City Office, or to a branch office or sub-branch office of the City Office.

The notification form should be submitted to the municipal office of the place of residence or place of birth.
The notification form should be submitted by the father or the mother.
Necessary Items

□Notification of Birth出生届(しゅっしょうとどけ)(Please have the hospital where the birth took place fill in the certificate of birth.)
□The Mother and Child Health Handbook for the child
□Your National Health Insurance Certificate (if you are enrolled in the scheme)

★The formalities should be completed within 14 days of the birth of the child.

2. Submit an Application for Permission to Acquire Status of Residence(在留資格取得許可申請) for the child’s stay in Japan.

The application should be submitted to the Hiroshima Immigration Services Agency.
The application should be submitted by the father or the mother.
Necessary Items

□A Certificate of Items Recorded on the Notification of Birth(しゅっ)(しょう)(とどけ)記載(きさい)事項(じこう)証明書(しょうめいしょ)
□A copy of your Certificate of Residence, showing all family members
□The father’s residence card
□The mother’s residence card
□The Mother and Child Health Handbook for the child
□Parents’ certificate of taxation
□Parents’ certificate of tax paid

★The formalities should be completed within 30 days of the birth of the child.
★ If your child has not acquired a status of residence within 60 days of birth, the child’s certificate of residence will be erased, and the child will become ineligible for certain government services, such as National Health Insurance, Child Allowance, etc.
★If you are leaving Japan within 60 days of the birth of the child, these formalities are not necessary.

3. Apply to the embassy or consulate in Japan of the country of the child’s nationality to have a passport issued.

※You can apply to have your child’s passport issued after you have applied for permission to acquire status of residence.

Notifications of Death(死亡届)

When an individual dies in Japan, you must submit a Notification of Death to the Citizens’ Affairs Division in the City Office, or to a branch office or sub-branch office of the City Office.

★ The notification form should be submitted within seven days of the date of death.

◆The notification form should be submitted to the municipal office of the municipality in which the individual died, or of the place of residence of the person submitting the notification.

◆The notification form should be submitted by a family member, or a person who was living with the deceased.

Necessary Items

□A Certificate of Death (made at the hospital where the person died)

Notifications of Marriage(婚姻届)

If you are resident in Japan and are marrying a Japanese person in the Japanese way, you need to submit a Notification of Marriage to the Citizens' Affairs Division in the City Office, or to a branch office or sub-branch office of the City Office.

If two non-Japanese people marry in Japan in the Japanese way, it is possible to submit a Notification of Marriage to the Citizens Affairs Division in the City Office, or to a branch office or sub-branch office of the City Office.
The non-Japanese person will also need to submit the Notification of Marriage to his/her own country (the country of his/her nationality). For details, please check with the embassy or consulate in Japan of the country in question.

In the case of marriage between a Japanese person and a foreigner, the notification form should be submitted to the municipal office of the village, town or city where the Japanese person is resident, or where his/her registered domicile is.
In the case of marriage between two foreigners, the notification form should be submitted to the municipal office of the village, town or city where they are resident.

◆The notification form should be submitted by the husband and wife.

Necessary Items

□1.The Notification of Marriage婚姻届(こんいんとどけ)
□2.A document to prove nationality (passport, etc.)
□3.Your birth certificate
□4.A ‘Certification of Legal Capacity to Contract Marriage
婚姻(こんいん)要件(ようけん)具備(ぐび)証明書(しょうめいしょ))’ issued by the embassy or consulate in Japan of your country (a document to prove that there are no legal impediments to marriage based on the laws of your country)
□5.Japanese translations of 2, 3 and 4 (the address and signature of the translator are needed)
□6.Your residence card

★If you are marrying a Japanese person, and his/her registered domicile is not in the municipality where the notification form is submitted, a copy of his/her family register戸籍(こせき)謄本(とうほん) is needed.

Notifications of Divorce(離婚届)

If a foreigner and a Japanese person living in Japan divorce, the Japanese law will be applied, and you can submit a Notification of Divorce by agreement.

In the case of two foreigners, you can submit a Notification of Divorce by agreement under the Japanese system only if divorce by agreement is accepted under the laws of your own country.
The non-Japanese person will also need to submit the Notification of Marriage to his/her own country (the country of his/her nationality). For details, please check with the embassy or consulate in Japan of the country in question.

〈In the case of divorce by agreement〉

In the case of divorce from a Japanese person, the notification should be submitted to the municipal office of the village, town or city where his/her
registered domicile is, or where he/she is currently resident.
In the case of divorce between two foreigners, the notification should be submitted to the municipal office of the village, town or city where they are resident.

◆The notification form should be submitted by the husband and wife.

□Your passport
□Your residence card

★ If the registered domicile of the Japanese person is not in the municipality where the notification is submitted, a copy of his/her family register is needed.
★ In the case of divorce between two foreigners, proof of marriage is needed.
